ABSTRACT: The future of legal orders in sub-Saharan Africa demands attention for two reasons. One, state laws are cultural constructions with colonial continuities. Two, the normative spaces shared by state laws and indigenous African laws are sites of resistance and adaptation. Enlightened by legal history and six years of field research, I argue that the interaction of legal orders should be perceived from the manner Africans adapt indigenous laws to legal, economic, cultural and religious changes in intersectional social fields. Accordingly, the novel theory of adaptive legal pluralism offers a platform for the integration of legal orders in Africa.
PRESENTER: Dr. Anthony Diala, School of Law & Director, Centre for Legal Integration in Africa, University of the Western Cape, South Africa. He holds a doctorate African Customary Law from the University of Cape Town, a Master of Laws from the University of Pretoria, and degrees from universities in Nigeria and Uganda. His work uses an innovative concept of adaptive legal pluralism to chart a theoretical path to legal integration in Africa.
